Right of Withdrawal for Consumers

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities.

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the last partial shipment or the last item.

You can use the attached sample withdrawal form, which is not mandatory. You can also electronically complete and submit the sample withdrawal form or another clear statement on our website (https://www.agrarmarkt-engert.de/widerrufsformular). If you make use of this option, we will immediately send you confirmation of receipt of such a withdrawal (e.g., by email).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including the costs of delivery (with the exception of the additional costs arising from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. For this reimbursement, we will use the same means of payment as you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back or hand over the goods to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. You only have to pay for any diminished value of the goods if this diminished value is due to handling them in a way not necessary for examining the quality, characteristics and functioning of the goods.

Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to contracts:

for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons if their seal has been removed after delivery;
for the supply of goods if, due to their nature, they have been inseparably mixed with other goods after delivery.

Premature Expiry of the Right of Withdrawal

The right of withdrawal expires prematurely for contracts:

for the supply of goods that can spoil quickly or whose expiration date would be quickly exceeded;
for the supply of alcoholic beverages, the price of which was agreed upon at the conclusion of the contract, but which can only be delivered at the earliest 30 days after the conclusion of the contract and whose current value depends on fluctuations in the market over which the entrepreneur has no influence.
